Legal notice
The Agència per a la Qualitat del Sistema Universitari de Catalunya (hereinafter, "AQU Catalunya"), with Tax ID number Q0801199A, is a public law entity subject to private law, with its own legal status, its own assets and full capacity to fulfil its objectives, in accordance with Article 1.1 of Law 15/2015, of 21 July, on the Agència per a la Qualitat del Sistema Universitari de Catalunya.
The purpose of this legal notice is to establish the principles and terms of access and use by users of the AQU Catalunya website and content.
Personal data protection
Personal data controller and purposes of processing
AQU Catalunya, with Tax ID number Q0801199A, is the owner and controller of the processing activities for the collected and managed personal data.
The personal data provided through the forms on the AQU Catalunya website will be used in processing activities depending on the purpose for which they are sent.
AQU Catalunya guarantees the privacy of its online services in accordance with legal requirements and provides information on its personal data protection policy so that users may freely and voluntarily determine their willingness to provide AQU Catalunya with their data by means of the electronic form for subscription to the services offered by AQU Catalunya on its website.
AQU Catalunya guarantees the confidentiality of the personal data provided by users and its processing in accordance with current legislation on personal data protection (Organic Law 3/2018, of 5 December, on the protection of personal data and guarantee of digital rights, and Royal Decree 1720/2007, of 21 December, approving the Regulations implementing the Law, as well as all other regulations applicable in this regard).
AQU Catalunya has adopted the legally required levels of security for the protection of personal data, and has installed all the technical means and measures within its power to prevent the loss, misuse, alteration, unauthorised access and theft of the personal data provided. However, users should be aware that Internet security measures are not fully impregnable.
The personal data requested from users consists solely of general identification data and that which is strictly necessary for the provision of services. This data will be processed and incorporated into the corresponding files of AQU Catalunya. The latter will implement the appropriate technical resources so that, prior to the submission of personal data, users may access this notice on the personal data processing policy and any other relevant information, and may give their consent for AQU Catalunya to process their personal data. Except where otherwise indicated, responses to queries about personal data are voluntary.
The collection and processing of personal data, resulting from users browsing the website, consulting or requesting any of the services offered by AQU Catalunya, is aimed, in addition to providing users with a personalised experience on the AQU Catalunya website, at the management, administration, provision, extension and improvement of the services to which users decide to subscribe, register or use, and the adaptation of the aforementioned services to the needs of the users.
The collection and processing of personal data is also aimed at the quantitative and qualitative study of visits and the use of services by users, the design of new services related to AQU Catalunya's own services and their updates, and the sending by traditional or electronic means of information on the services offered by AQU Catalunya.
In no case will AQU Catalunya use the personal data of users for purposes other than those mentioned above, unless prior warning is given on the website.
AQU Catalunya extends this personal data protection policy to the rest of its activities.
Transfer of personal data
AQU Catalunya may communicate personal data to other entities under the terms indicated in the information clause of each procedure, application, registration in the AQU Catalunya newsletter or other activities that require the user to provide certain personal data in order for the Agency to carry out the activity.

Personal data storage period
The personal data collected will be kept either for the period indicated in the information clauses, or in accordance with the provisions of the applicable regulations in each case.
Rights of the data subjects and how to exercise them
Citizens can exercise before AQU Catalunya the following rights granted to them by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GRPD), and Organic Law 3/2018 of 5 December on the protection of personal data and guarantee of digital rights:
- Right of access of the data subject: is the right of the data subject to obtain confirmation from AQU Catalunya as to whether or not personal data concerning him or her is being processed and, where this is the case, access to said data.
- Right to rectification: is the right of the data subject to obtain rectification of his or her personal data if it contains inconsistencies, errors or is incomplete.
- Right to erasure: is the right of the data subject to have his or her data erased and no longer processed by the controller.
- Right to restriction of processing: is the right of the data subject to mark his or her stored personal data in order to restrict its processing in the future. The restriction of processing may be requested when the data, among other things, is inaccurate or when the data subject has objected to its processing and, therefore, the data controller does not have the data subject's consent.
- Right to portability: the data subject has the right to receive personal data that he or she has provided to a controller in a structured, commonly used and machine-readable format and have it transmitted it to another controller.
- Right to object: is the right of the data subject to object to the processing of his or her personal data so that it is not processed for certain purposes.

AQU Catalunya will respond to your request within the legally established deadlines according to the right you wish to exercise.
Likewise, users may exercise their right to be informed of the purposes for which they authorise the use of their data, of the transfers made by AQU Catalunya of their data to third parties who need the personal data in order to provide the service efficiently through this legal notice and, where appropriate, through the corresponding notices given by AQU Catalunya to users.

Access to and use of content
Provided that it does not breach the licence or legal notice of a particular work, which is what prevails, anyone is permitted by AQU Catalunya to reuse the content and data without any kind of temporal limitation or restriction, under the terms established by the legal instrument CC0 by Creative Commons, in accordance with Article 17.1 of Law 19/2014 of 29 December on transparency, access to public information and good governance and beyond the basic conditions established in Article 8 of Law 37/2007 on the re-use of public sector information (citation of the source, no alteration or distortion of the information and specification of the date of the last update).
The content provided on the AQU Catalunya website is managed and prepared by AQU Catalunya, with the exception of information that comes from sources external to the website itself, for which the source, medium and any other information relating to its origin will be stated. In these cases, AQU Catalunya does not accept any liability for the inaccuracy or outdatedness of the information from these external sources, given that it is only liable for the content from its own sources and which is duly identified by copyright.
It should be noted that the legally valid versions of the calls and the main administrative procedures arising from them are those which are published in the Diari Oficial de la Generalitat de Catalunya (Official Journal of the Government of Catalonia) or, where appropriate, in the official journals of other public administrations.
AQU Catalunya also undertakes to build a website with a responsive, usable and accessible design in order to guarantee access for all users, regardless of their physical, sensory or intellectual abilities or the device they use to connect to it.
Modalities of information re-use
In accordance with Article 17.1 of Law 19/2014, of 29 December, on transparency, access to public information and good governance, the re-use of public information is free and not subject to restrictions, except in cases where, under the regulations a specific license must be obtained, on the grounds of protecting other rights or legal assets, or to the prior request of the data subject.
Law 37/2007, of 16 November, on the re-use of public sector information, which transposes Directive 2003/98/EC of the European Parliament and of the Council, and is amended by Law 18/2015, of 9 July (which in turn transposes Directive 2013/37/EU), regulates the re-use of public information owned by public administrations and the bodies in which they have a majority stake, in other words, the right of all potential market agents to re-use information from public bodies. In accordance with these regulations, the Generalitat de Catalunya permits the public reproduction, distribution and communication of the work and, in addition, the transformation of the work to make derivative works, for the whole world and with no temporary limitation, in accordance with the legal instrument CC0 by Creative Commons, and provided that it does not breach the licence or legal notice of a particular work, which is what prevails.
In order to re-use the information, the following conditions must be met:
- The meaning of the information must not be distorted.
- The source of the information must always be cited.
- The date on which the information was last updated must be stated.
The source must always be cited as the Agència per a la Qualitat del Sistema Universitari de Catalunya, except in cases where a specific licence exists, in which case the authorship and ownership of the exploitation rights must be acknowledged.
Other modalities of re-use
Re-use may also be limited on the grounds of protecting other legal rights which take priority, such as the personal data protection, privacy or intellectual property rights of third parties. The re-use of copyrighted works can be formalised through the use of open licences, such as Creative Commons licences, which grant certain rights to exploit the works. For content to which this type of licence applies, re-use is permitted under the conditions established therein.
The use of AQU Catalunya’s logos and distinctive symbols in general is not permitted in any way whatsoever. These elements that make up the corporate visual identity are the exclusive property of AQU Catalunya and are protected by the applicable current legislation.

Liability
AQU Catalunya will not be liable for damages of any nature that may arise from access to the content, information, opinions, concepts and images provided by users or third parties that contravene the law, morality, good faith and public order, that infringe intellectual and industrial property rights or that contain flaws, defects or computer viruses or similar software routines.
AQU Catalunya is not aware of any content hosted on its website that contravenes the law, morality, good faith and public order, that infringes intellectual and industrial property rights or that contains flaws, defects or computer viruses or similar software routines.
The moment AQU Catalunya becomes aware of the unlawfulness of any of the content, opinions and concepts hosted on its website, or which contain computer viruses or similar software routines, it will immediately remove these within twenty-four hours, except in cases of force majeure.
AQU Catalunya is exempt from any liability for damages of any kind arising from the collection and use by third parties of the information and opinions provided by users of the website that it manages.
In any case, AQU Catalunya is not liable for information and content external to its websites that it does not manage.
